HUGE NUMBER OF CASES PENDING IN INDIAN COURTS

According to a written reply submitted in the Rajya sabha few months back by the Law Minister Sri Arjun Ram Meghwal, 5.02 crores cases are pending in various courts across India. Out of these cases, over 1,69,000 are pending in different Districts and High Courts for over 30 years. As on 2022 December about 85% of these cases are pending in District Courts. Surprisingly the government itself is the biggest litigant having 50% of these cases are sponsored by the state. And most interestingly India has the largest number of court cases pending in the world. As per strategy paper of the Niti Aayog submitted in 2018, it would take about 324 years to clear the backlog at the prevailing rate of disposal. Hence in most such cases the victim and the accused pass away without knowing the justice by themselves.

As on 2022 the sanctioned strength of judges in India was 21.03 judges per million population. According to available information the sanctioned strength of judges in  Supreme Court was 34, the High Courts were 1,103 and the District Courts were 24,631. The pendency of cases in large numbers and for over a long time shows the inadequacy of judges in our country. The number of judges per million population are much higher in Europe and USA comparing to ours. Since delaying justice pulls out the charm of life of a honest one, it should be the top most priority to provide justice in time for all citizens of the country. No amount of reasons can make good for the delayed justice. Adjournment of cases in courts too should be strictly restricted by law.

It is proposed, therefore, that the Government of India may appoint an independent commission to conduct a detailed survey and submit a report clearly indicating the present number of judges required in District Courts, High Courts and Supreme Court. Additional requirements of staff may also be indicated category wise. In the case of court buildings are to be extended and furniture to be added the same may also be indicated in detail. Further to these, it is proposed to have a few number of Special Courts to deal with POCSO cases and cases related with sexual assault on women, in every state. The judiciary itself may take up this issue with the government for a speedy process of this matter and successful execution well in time.
