ORGAN TRADE IN INDIA

Image
Human  organs trade is in the news for quite sometime. According to a report there is a demand of over two lakh kidneys annually but availability through donors is only around 3%. Liver, kidney, pancreas, heart, lung, intestine, cornea etc are the human organs generally transplanted. Organs must be removed as soon as possible after the determination of brain death, while circulation is being maintained artificially. Human organ and tissue transplantation was started in India in 1962. At the initial stage the organ trafficking was rampant as it was not well regulated. The act governing transplantation came into being in 1994 and was subsequently amended in 2011. The new rules came into force in 2014. All relevant aspects like donors, brain death, regulation of transplant activities etc are strictly specified in the law. Human organs trafficking is caused by the large gap between demand and supply.  There is a demand for over 2.5 lakhs kidney every year in India. Onl...

Among the states Kerala has a higher ratio of female population which is 1084 female per 1000 male population. Kerala has 140 + 1 seats in the Legislative Assembly which has 8 female members or 5.7% female representation. We all talk very high about our democratic system which stands on liberty, fraternity and equality. Articles 14, 15 and 16 of the constitution stipulate equality of all citizens of this country. Here comes the question, why women do not become eligible for this provision of the law. As per the population of women in India, are they not eligible to represent them in the Indian parliament and the state legislative assembly under the same principles of equalit...

PUNISHMENT FOR RAPE

Image
(Continued from yesterday) All said and done, the heinous crime of rape is mounting up in our country. The most pathetic aspect is that some governments try to cover up some cases on political considerations. Police are misused for this purpose. It is high time that the central government must relook into this and try to shape a most comprehensive law throughout the country with the intention of effectively preventing this heinous crime. Known people from various walks of life may be found and their opinions may be sought for the formation of the law with the sole intention of wiping out this brutal crime from our country. Sociologists, educationists, lawers, judges, women activists, journalists, writers etc both men and women be asked to submit their opinions. However, the most important aspect to consider in this regard is that even after seven decades from getting independence our women cannot freely move within our country. After dusk even our towns and cities are fears...

PUNISHMENT FOR RAPE

Image
............. Continued from yesterday Those  who demand death penalty for rapists argue that while committing this crime the accused is in his normal sense. There is always presence of mental element to make physical relationship with a girl even without her consent. Granting imprisonment for several years cannot change the mindset of the accused persons and, therefore, no reformation takes place. Another argument in support of capital punishment is that a rapist is not safe for the society and hence should be given death penalty which can be an example for the society and as such the cases of rape can be reduced. In rape cases,  age of the victim should not be considered for granting death penalty. Rape is more common in India than murder. While murder stands at 2.2 rape is at 5.2 in 2017 according to NCRB. Even though such huge amount of rape cases take place in our country only a very few get public attention and the issue is brought to the streets and demand r...

Image
(Report by Times of India dt 26.10.20) Continued from yesterday. We have made enough laws to prevent this most inhuman act. Media reported a case from Uttar Pradesh in the recent past that a young a girl was raped by a group of people and after that pulled out both her eyes and cut off her tongue. Can men become so cruel to fellow beings? The existing law stipulates life imprisonment or even death penalty for rapists, but the crime continue all over the country. There are differences in opinions of punishment for rape. While some suggest death penalty others are against. Let us now find how other countries are handling rape cases. France hand out 15 year sentence for rape, which can be extended to 30 years or life depending on the extent of damage and brutality. China award execution or castration for rape but without proper trial. There are cases of convicted rapists were executed and later found innocent. The punishment in Saudi Arabia is public beheading after administer...
