TRANFER OF GOVT STAFF IS CONSIDERED AS PUNISHMENT


It has been found for quite sometime that government staff in Kerala, reported to have committed serious offences are transferred as punishment. The Honourable Supreme Court held that the order of transfer cannot be said to be punitive in nature .... In many of such transfers the employee involved has caused considerable loss to the public exchequer. Normally, it is found that the issue of transfer order ends the matter and no punitive action or the recovery of loss is initiated thereafter. In the cases of petty offence, suspension from service and in serious offences dismissal are the apt punishments prescribed. Under what interests government take a lenient view on this is not known.

The government may seriously consider this matter.
