CAN AN AGREEMENT BE VALID FOR 999 YEARS AS PER INDIAN LAW? CAN A CONCRETE DAM LIVE UPTO 999 YEARS?


A lease indenture signed between the Maharaja of Travencore and the secretary of state for India in 1886 with a validity for 999 years, is what caused the  current tussle between Kerala and Tamil Nadu for irrigation  water from Mullaperiyar dam. 999 years is something over 30 human generations. Under any law anywhere in the world, can anyone ask anyone after ten, twenty or thirty generations what to give to whom and from where and how much? Did the signatories know that no such concrete dam in the world will survive for such long time of 999 years. From what is seen in this world a concrete dam cannot survive over 100 plus years. More amuzing and confusing is that why no one has brought this to the notice of the honorable judiciary. More than these the geographical and population combination have distinctively changed since the signing of this 'comedy of errors'.

Let us also know that the Portland cement being used today was invented in 1824 by the English brickayer 
Joseph Aspdin. Hence we cannot find a functional dam older than two hundred years. As per the  999 years agreement the operational and maintenance work of the  dam rest with Tamil Nadu. However they have to take the consent for the same from the Government of Kerala.

If the Mullaperiyar dam breaches, the surge of water may cause a catastrophic damage to Idukki dam. Let us not, therefore, risk the lives of large number of people down to the extent of Kochi. Let us reopen the matter with the Apex Court and take permission to strengthen or reconstruct the dam. We may also seek approval to get the existing 999 years agreement cancelled. In it's place the Government of Kerala may give a written consent to their counterpart.in TN to supply the water to them. Under no circumstances we may risk with human lives, that too uncountable.
